UNABLE TO PERSONALLY ATTEND; ONE DRAWING PER SPOT PER IMMEDIATE FAMILY
If for any reason you are unable to personally attend the lot release on Saturday, you may send a representative in your place, but your representative must be in possession of the registration documents described in the Lot Release Guidelines and properly completed and signed by the actual buyer, together with the reservation deposit check from the actual buyer, for the representative to be able to deliver to us on your behalf. If you are represented by a broker, your broker may act as your lot selection representative, however, a broker may only act as a lot selection representative for one customer at the pre-construction lot release. Lot drawing spots are not transferrable so whatever number is given out to a buyer, the persons/couple with that reservation number are the ones that will have to go to reservation and contract. Only one lot drawing spot per immediate family will be given out (this does not include adult children buying for themselves; such adult children may receive their own numbers but they may not be used by or transferred to other family members). If it is determined that any person or immediate family received more than one number for the drawing their reservation will be cancelled.

WHEN MY NAME IS CALLED DURING THE RANDOM DRAWING PROCESS, WHAT DO I NEED TO DO?
You need to select the homesite and floorplan that you will purchase.
WHAT IS THE DEPOSIT REQUIRED?
A $5,000 reservation deposit is required to hold a lot. A deposit of 10% of the purchase price will be required to be paid as follows:
(i) 5% at time of execution of contract (less the $5,000 reservation deposit); and
(ii) 5% thirty (30) days after the execution of the contract.
The checks should be made payable to Atlantic Commons Associates, LLLP and must be in the name of the buyer and drawn on a US financial institution. No third-party checks and no credit cards will be accepted.
ARE THERE ANY INCENTIVES?
We are offering $2,500 toward closing costs if you use GL Financial when obtaining your loan and Nova Title Company as your closing/title agent. Be aware that in order to receive the $2,500 toward closing cost credit, you will have to apply with GL Financial for a pre-approval (including submitting all financial and other information required for such pre-approval) within thirty (30) days following execution of the Purchase Contract.
HOW AND WHEN CAN I GET PRE-APPROVED WITH GL FINANCIAL?
You may call GL Financial at (866) 814-7100. Also, at the time you reserve a homesite and floorplan, you will be assigned an appointment with a representative from GL Financial to begin the pre-approval process.
CAN I FINANCE USING AN FHA/VA LOAN?
Yes, but a 10% contract deposit is still required.
WHAT TYPE OF RECREATION FACILITIES DOES THE DEVELOPMENT HAVE AND WHEN ARE THEY GOING TO BE READY? WILL ALL HOMEOWNERS BE ALLOWED TO USE THE REC FACILITIES?
The recreational facilities will include a clubhouse with a fully equipped fitness center, event room, resort style pool with 2 lap lanes, tennis court, basketball, tot lot, grilling area and open play area. The clubhouse in Phase 1 is expected to be completed by early 2016. The buyers in Phase 1 will only be allowed to use the amenities in Phase 1 and the buyers in Phase 2 will only be allowed to the amenities in Phase 2.
IS THE DEVELOPMENT GATED?
The resident, guest and exit lanes will feature automatic barrier arms as well as metal decorative gates. Both gates will operate via a garage door opener or other access mechanism. The guest gate will eventually operate by a telephonic access system.
WHAT IS THE MAINTENANCE FEE AND WHAT DOES THE MAINTENANCE COVER?
The fee for owners in Phase 1 is approximately $210 per month (paid quarterly). The maintenance includes lawn and irrigation maintenance for individual lots, fees for upkeep of the common area amenities, clubhouse, the monitoring of your security system and sprinkler service.
WILL YOU ALLOW INVESTORS?
No. There will be deed restrictions limiting your ability to lease or sell the home within 1 year following closing which will include payment to the seller of any financial gain from any such sale. Also, no buyer will be permitted to buy more than one home in Tuscany. See purchase contract for more information.
CAN WE RENT THE HOME AFTER WE CLOSE?
As part of the investor restrictions, the home may not be rented or sublet during your first year of ownership following closing. Thereafter, the HOA Documents restrict rentals to a minimum 12-month lease.
WHAT ARE THE PROPERTY TAXES?
Property taxes are approximately 1.65% of the total purchase price.
ARE PETS ALLOWED?
Common domesticated pets are allowed but not for breeding or commercial purposes. No other animals, livestock, horses, reptiles or poultry are allowed. Pitbulls, Rotweilers, Doberman Pinschers, Canary Dogs, Staffordshire Terriers, Staffordshire Bull Terriers or any “dangerous dogs” are not permitted on any portion of the property. A dangerous dog is one that has aggressively attacked or chased a person or other animal. See the HOA Documents for additional rules regarding pets.
WHAT SCHOOLS WILL MY CHILDREN BE ATTENDING?
Spanish River High School – located on Jog Road in Boca Raton
Carver Middle School – located on Barick Road between Military and Congress, just off Atlantic Ave in Delray Beach
Hagen Road Elementary – located on Hagen Ranch Road in Delray Beach. Placement is, however, at the discretion of the school board.
WILL THERE BE GAS IN THE COMMUNITY?
No, all appliances will be electric.
ARE POOLS BEING OFFERED?
No, the homesites do not accommodate pools.
